South Florida Victim's Rights Attorney Welcomes Victim Advocate to Practice

Recession Has Hurt Most Elder Law Firms, Survey Finds

To the surprise of some, elder law firms have been hit hard by the recession, according to the results of a new survey by ElderLawAnswers, the Web's leading source of consumer and professional information on elder law.

Most surveyed elder law firms (71 percent) have experienced a decline in business due to the economic downturn. Firms have seen an average 25 percent decline in business, although about 20 percent have had to cope with a precipitous 40 to 50 percent drop-off. "Anything (clients) can put off they will put off -- including their estate plans," commented one respondent.
"We're surprised at the results," said ElderLawAnswers president Harry S. Margolis, an elder law attorney in Boston, Mass. "We were assuming that the practice of elder law would be better insulated from recessionary forces because of the necessity of the work these attorneys do."

The survey found that to make up for revenue shortfalls, firms have had to trim bonuses, cut staff, reduce salaries and even delay paying bills. Pruning bonuses has been the most common cost-cutting move among surveyed firms, followed by laying off support staff and reducing salaries.

Firms have also been forced to shift the focus of their practices. More than three-quarters of respondents (77 percent) say that as a result of the slump, they are concentrating more on practice areas that clients are less likely to defer. Topping the list of new areas of focus is estate administration, followed by crisis Medicaid planning and special needs planning.

Firms ranked estate administration, guardianship and conservatorship and crisis Medicaid planning as the best-performing practice areas compared to last year. Advance long-term care planning and fiduciary litigation were ranked lowest.

ElderLawAnswers also asked elder law attorneys how long they think it will take for the economy to rebound. Twenty-seven percent predict one year, 32 percent think it will take two years, 21 percent say it will be three years, 5 percent say four years and 8 percent expect to wait more than four years. An optimistic 5 percent say we'll be out of the woods in six months.

Finally, most of those surveyed believe that even after the economy recovers, the practice of elder law will never be the same, due both to the recession and to other changes in the market for legal services, such as the rise of the Internet. In an open-ended answer section, respondents explained how they believe the practice of elder law will be altered in the years ahead.

Detailed survey results will be published September 28, 2009, in the October 2009 issue of ElderLawAnswers Monthly, with a circulation of 7,500 elder law professionals.

Recently judges have shied away from supporting arguments that expand homeowner rights by modifying the foreclosure process. Even though 2923.5 clearly requires the courts to take additional steps to help homeowners, most deny requests to stay foreclosure or eviction proceedings pending the outcome of litigation. United Law Group has filed appeals in several cases where the firm believes appellate review will benefit California homeowners.

New York Personal Injury Lawyers Comment on Taxi Slamming into a Horse-Drawn Carriage, Injuring Two

When word came in over the newswire that a horse-drawn carriage had been struck by a taxi near Central Park in New York, personal injury lawyers, who thought they had seen it all, were reminded they hadn't.

According to the New York Post, the cabby allegedly suffered a seizure when he slammed his cab into the empty horse-drawn carriage, smashing it before crashing into a wall.

Both the drivers of the taxi and the carriage were hospitalized for non-life-threatening injuries. The horse was unhurt.

San Jose Jury Understands the Severity of Traumatic Brain Injury

Recognizing the staggering costs of healthcare associated with traumatic brain injury, a San Jose jury awarded Drew Dakota Bianchi $49,123,375.87 late Monday afternoon (September 21, 2009). The verdict, which was delivered in Santa Clara County Superior Court, Action No.: 1-08-CV-104548, followed a hotly contested five-week trial involving two truck drivers who collided on State Route 152 (Pacheco Pass), one of whom thereafter struck the car in which plaintiff was a passenger.

Plaintiff, Drew Dakota Bianchi, was a 21-year-old passenger in a Toyota Avalon, when, on May 3, 2007, he was struck by a Peterbilt truck driven by defendant, Samuel Bimbela. Evidence at trial established that Mr. Bimbela, driving his Peterbilt truck, and codefendant Mr. Michael Demma, driving a Gordon Trucking 18-wheel big rig, struck each other at or near the centerline on State Route 152. No pre-impact evasive maneuvers were undertaken by either driver.

Mr. Bianchi, whose injuries necessitate a lifetime of 24/7 care, brought suit against both truck drivers/trucking companies, as well as the State of California.

Representing attorney Randall M. Scarlett of San Francisco noted: "This is a situation where the jurors fully understood the long-term implications of a traumatic brain jury case."

The jury, recognizing the devastating cost of future care for an individual sustaining traumatic brain injury, awarded $3.4 million in past medical expenses, $27.6 million in future medical expenses, $4.5 million for future lost wages, and $13.5 million in general damages.

The jury attributed fault in the amount of 35% to Gordon Trucking/Michael Demma, 60% to Samuel Bhnbela, and 5% to the State of California.

The verdict is thought to be one of the highest non-punitive verdicts in the State of California for an individual sustaining traumatic brain injury.

Energy Security and Industry Accountability Targeted in New Legislation by Bipartisan Senate Group

The Revenue Watch Institute urges the Senate to take swift action on the bipartisan "Energy Security through Transparency Act of 2009," introduced today by Senators Richard Lugar (R-Ind.) and Ben Cardin (D-Md.). The bill, which will revise U.S. Securities and Exchange Commission guidelines, is a small change that will spark great rewards in financial and political stability for the energy sector worldwide and here in the United States.

The legislation will require oil, gas, and mining companies to disclose how much they pay foreign countries and the U.S. government for oil, gas, coal and other minerals. Three other senators are original co-sponsors of the bill, including Senator Charles Schumer, (D-N.Y.), who introduced a similar bill last year, along with Senators Roger Wicker (R-Miss.) and Russ Feingold (D-Wis.).

Revenue Watch Institute Director Karin Lissakers said the adjusted reporting guidelines are "a win-win proposition for investors and for communities in resource-rich countries," where corruption and the suspicion of corruption frequently undermine the public trust, efficient oil and mining operations, and even national stability. "When companies publish what they pay to governments, they give investors decision-useful information, help local communities keep their leaders honest, and foster the stability that keeps investments flowing and secure," said Lissakers.

The rule change, if approved by Congress, would mark the first time energy companies were required to release raw materials expenditures on a country-by-country basis.

"Citizens in the poorest nations shouldn't pay the price for their government's mismanagement of their most valuable resources. Despite Safety Changes to SUVs and Pickups, Highway Threats Remain, Says NY Lawyer

Even though automakers have just redesigned sport utility vehicles and pickups to make them less deadly in collisions with other cars, older model SUVs and trucks on the highway still pose a serious threat in crashes, a New York attorney says.

"A vehicle design defect or flaw can cause or certainly contribute to a serious accident or make the injuries much worse," says Steven J. Schwartzapfel, founding partner of Schwartzapfel, Truhowsky Marcus P.C., a New York personal injury law firm that represents victims of car accidents. "We welcome advances in automotive safety, but the roadways remain a dangerous place. We deal with the death and devastation caused by crashes involving smaller cars and heavier SUVs every day."

Occupants of passenger vehicles including cars, minivans, pickups and sport utility vehicles represent by far the largest number of deaths in motor vehicle crashes, according to an analysis of U.S. Department of Transportation data by the Insurance Institute for Highway Safety. In 2008 alone, 25,428 people died in crashes in passenger vehicles.

Frontal impact collisions account for more half of those deaths, side impact collisions represented 28 percent of fatalities and rollovers accounted for most of the rest, according to the Insurance Institute.

People in lighter vehicles remain at a disadvantage in collisions with heavier vehicles. In multi-vehicle crashes involving cars and SUVs or pickups, the occupants of the cars are more likely to die, and their vehicles usually sustain greater damage.

On the other hand, pickups and SUVs are proportionately more likely to be in fatal single-vehicle accidents, especially rollovers, the Insurance Institute said. Crashes in which a vehicle overturned represented 35 percent of passenger vehicle occupant deaths in 2008 and claimed more than 9,000 lives.

Overall, more than 280,000 rollover accidents are reported each year, according to the National Highway Traffic Safety Administration.

Auto manufacturers had a deadline of Sept. 1, 2009 to redesign their SUVs and pickup trucks to make them less deadly in frontal and side-impact collisions with passenger cars. The safety changes were to address the problem of taller SUVs and pickups overriding smaller cars' bumpers so that the car frame could not dissipate the energy of a crash, causing more harm to passengers.

Automakers notified the National Highway Transportation Safety Administration earlier this year that all vehicles would be in compliance by the deadline, according to The New York Times.

Women Legislators Support USOBA Debt Settlement Services Act, Reject ‘Advance Fee Ban’

The National Foundation for Women Legislators’ (NFWL) National Policy Committee on Business, Housing & Economic Development passed a resolution this week in support of the United States Organizations for Bankruptcy Alternatives’ (USOBA) Debt Settlement Services Act. The NFWL has called for state and federal regulation of the debt settlement industry based on the provisions of the Act, which provides strong consumer protection while preserving the rights of ethical debt settlement companies.

USOBA, a trade association dedicated to the advancement of consumer protection in the debt settlement industry, developed the Debt Settlement Services Act to provide nationwide and uniform transparency to the debt settlement industry. The Act mandates a registration or licensing of debt settlement providers within each state and encourages certification in one of two debt settlement trade associations. It also requires specific fee disclosures, designed to ensure that consumers are empowered with information about the programs offered, and rejects any “advance fee ban” in favor of more reasonable limits on fee collection.

"If you experience any major life changes - marriage, divorce, and birth of a child or death of a spouse or child - update your estate plan immediately," he says. "Generally, any change in your personal, family, financial or health situation or a change in the tax laws, could prompt a change in your estate plan. It's a good idea to review your estate plan every year. Set aside a specific time every year (birthday, anniversary, family gathering) to review it."
